Onmindo terms of service

Using Onmindo means agreeing to this page. It is written to be read, so it is in plain sentences rather than in capital letters, and it says what it means the first time.

Who you are agreeing with

Onmindo is built and run by Eliran Suisa, trading as Webo Tech, in Israel. There is no company behind it and no team. Write to [email protected] about anything on this page, including a complaint.

The service is the marketing site at www.onmindo.com, the application at app.onmindo.com, and the Onmindo browser extension. "Onmindo", "the service", "we" and "I" all mean the same thing on this page.

What Onmindo is

Onmindo tracks whether the mail you send from your own Gmail account was opened, and which of several recipients opened it. It also schedules sends, sends follow-ups, runs multi-step sequences, keeps templates and signatures, and publishes a booking page on your own Google Calendar.

Every message goes out through your Gmail account. Onmindo is not a mail provider, does not relay your mail through a service of its own, and does not send anything you did not ask it to.

Your account

Signup is open. You sign in with Google, and the address on that Google account is the address on your Onmindo account.
An account is for one person. Your API token authenticates every call the extension makes on your behalf, so treat it the way you would treat a password. You can replace it at any time in Settings, which disconnects every extension holding the old one.
You are responsible for what happens under your account, including anything done by somebody you gave access to.
You must be old enough to enter a contract where you live, and you must not be barred from using the service under the laws that apply to you.

Your Gmail account stays yours

Connecting Gmail grants Onmindo the narrowest permission each feature needs, and you can see exactly which, and when it is asked for, on the privacy page. You can take all of it back at any time, either in Settings or at myaccount.google.com/permissions.

Your use of Gmail and Google Calendar is between you and Google and is governed by their terms, not by this page. Onmindo's use of data received from Google APIs follows the Google API Services User Data Policy, including the Limited Use requirements, which the privacy page sets out in full. Gmail is a trademark of Google LLC and Onmindo is not affiliated with, endorsed by or sponsored by Google.

What it costs

Nothing, today. Every feature is free, no card is asked for, and no payment processor is connected to the service. What it is expected to cost later is published in advance so that the numbers are not a surprise on the day they start applying.

Two promises about that, which are the point of publishing early:

Nobody is moved onto a paid plan without being asked first. An account that does nothing stays on the free tier.
Tracking that is already running is never switched off or degraded to sell you something. Data already recorded is never put behind a payment.

When there is something to pay for, payments will be taken by Paddle, which acts as the merchant of record: Paddle is the seller on the receipt, handles the payment and charges any sales tax or VAT that applies where you are. Refunds are on the refund policy page. Prices are in US dollars and exclude any tax added at checkout.

What an account may not be used for

This section is short and it is the one that matters. Onmindo serves every account's tracking pixels and rewritten links from one hostname, so the reputation of that hostname is shared by everybody using the product. One account abusing it can get the domain blocked by mail providers and browsers, which stops tracking working for every other user at once. That is why the list below is enforced rather than decorative.

You may not use Onmindo to:

send mail to people who have not agreed to hear from you, where the law that applies to you requires that they have, or send mail that breaks any anti-spam law that applies to you or to your recipients;
send anything deceptive about who it is from, including a forged sender, a misleading subject line, or an address that impersonates somebody else;
use a rewritten link to disguise where a reader is being sent, or to point at malware, a phishing page, or anything designed to take credentials or money by deception;
mint tracking links you do not intend to put in mail you are actually sending, or use the service as a general purpose redirector, URL shortener or file host;
send bulk mail on behalf of somebody else's list, resell the service, or run more than one account to get around a limit;
probe, scrape, overload or work around any limit in the service, or try to reach another account's data;
break any law that applies to you, or infringe anybody's rights.

The target of every link Onmindo is asked to rewrite is checked against Google Safe Browsing. A target already known to be malicious is left alone: the message still sends carrying your own address, and Onmindo simply does not put a redirect on its own domain in front of it.

What happens if it is

An account being used for anything in the list above can be suspended or closed, and the tracking links it minted can be switched off, without notice. Where there is a way to warn you first and it is safe to do so, you will be warned first. Where the damage is ongoing, you will not be.

Reports of abuse go to [email protected] and are acted on. If a link on an Onmindo domain sent somebody somewhere it should not have, that address is the one to use.

What you are responsible for as the sender

You decide who to write to, what to say, and whether to turn tracking on for a message. That makes you responsible for the mail, and for following the rules that apply to it.

Some jurisdictions regulate tracking pixels specifically, and some require that you tell people or ask their consent before tracking whether they opened a message. Which rules apply depends on where you are and where your recipients are, and that is a question about you rather than about Onmindo. Onmindo ships a per-recipient suppression list and a switch that turns tracking off for any message, and it ships no consent management. Find out what applies to you.

Under data protection law of the kind that uses these words, you are the controller of the personal data in the mail you send and in the records of who opened it, and Onmindo processes that data on your instructions. Write to [email protected] if you need a data processing agreement.

What tracking does and does not prove

A tracking pixel is an image request. It says that a mail client drew the message. It cannot say that a person read the words, and Onmindo never claims that it does. The limits are written down rather than hidden: Gmail's fetch at delivery time is recorded as delivered and never as an open, a second reader on the same Gmail account is served from Google's cache and cannot be seen at all, and an Apple Mail open is indistinguishable from Apple loading the message on its own schedule.

So the service is provided as it is, with no promise that any given open, click or delivery is recorded, or recorded correctly. Do not use it as the only evidence for a decision that matters.

Availability, and who to expect

There is no uptime commitment, no service level agreement and no support rota. One person runs this on one server, and replies to [email protected] come from that person, usually within a couple of working days.

Features can change or be withdrawn. Anything that would lose your data or stop something you rely on gets notice by email to the address on your account first.

Pixels and links in mail you have already sent keep being served even when the application moves to a new address, because a message already in somebody's inbox cannot be edited.

Your data

What is stored, where, and who can reach it is set out on the privacy page, which is part of these terms. In short: your data is used to run Onmindo for you and for nothing else. It is not sold, not shared, and not used to train anything.

The dashboard shows everything held about your account and lets you delete any of it. To delete the account itself, email [email protected] from the address you signed up with. It is done by hand, promptly, and it is permanent.

You keep every right in the content of your mail, your templates and your signatures. Onmindo claims no licence over them beyond what is needed to run the features you turned on.

Liability

The service is provided as it is and as it is available, with no warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.

Onmindo is not liable for indirect or consequential loss, for lost profit, lost business, lost data or lost opportunity, or for anything arising from an open that was recorded wrongly or not recorded at all.

Where liability cannot be excluded, it is limited to the greater of the amount you paid for Onmindo in the twelve months before the claim, or one hundred US dollars. Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that the law says cannot be limited, and nothing here takes away a consumer right you have where you live.

Ending it

You can stop at any time: disconnect Gmail, uninstall the extension, and ask for the account to be deleted. If you are on a paid plan, cancelling stops the next renewal and access runs to the end of the period you paid for.

Onmindo can end your access for a breach of the acceptable use section above, or by giving you thirty days' notice for any other reason, in which case anything you have paid for and not yet received is refunded.

Ending it does not delete your data on its own. Ask, and it is deleted.

Changes to these terms

This page is versioned alongside the source code and dated at the top. When something here changes, the date changes with it. A change that materially reduces what you get, or adds an obligation, is emailed to the address on your account at least thirty days before it applies, and using the service after that is how you accept it. If you would rather not, stop using it and ask for a refund of anything unused.

Governing law

These terms are governed by the laws of Israel, and the courts of Tel Aviv have jurisdiction. If you are a consumer, this does not take away the protection of the mandatory law of the country you live in, or your right to bring a claim there.

If any part of this page turns out to be unenforceable, the rest of it still stands.
